The Supreme Court on Thursday upheld its permanent ban on firecrackers in the Delhi-NCR region, dismissing a plea by firework manufacturers seeking a temporary ban or permission for green firecrackers. The Court considered several applications filed by dealer and manufacturer associations challenging the ban imposed since December 2024. The bench led by Justice Abhay S Oka stated that the ban is essential due to the terrible air quality in Delhi-NCR.

Rationale for Upholding Ban

The Court emphasized that the ban is specific to Delhi-NCR only and reiterated that lifting the ban would not serve any purpose as crackers could be stored beyond the permitted period. The Court stressed that unless pollution caused by firecrackers is minimal, there is no question of lifting the ban.

Senior advocates assisting the Court highlighted the health hazards associated with firecrackers, especially during Diwali when air quality worsens. They pointed out that the ban is crucial for maintaining a pollution-free environment and ensuring public health. The Court also directed other states to enforce similar bans on firecrackers within two weeks.
